1. These terms, and who they apply to

These terms cover your use of Tapeback, a service that records conversations with your AI agent and replays them against a proposed change before it ships. They are a contract between Tapeback AB, of Hornsgatan 80, 118 21 Stockholm, Sweden (“Tapeback”, “we”) and the company that signs up (“Customer”, “you”).

The service is for businesses only, not consumers. By signing up you confirm that you are acting for your business and that you have the authority to commit your company.

The person who accepts these terms accepts them for the company, not for themselves. If you don’t have that authority, please don’t go ahead.

If documents disagree. This order applies: (1) a signed order form or agreement between us, (2) the data processing agreement, (3) these terms, (4) our Privacy Policy, (5) anything else on our website.

2. What the service is

Tapeback is a web application and a command-line tool. The recorder stores conversations between your agent and your users as tapes. When you propose a change to the agent, the command-line tool replays a sample of recent tapes against the changed agent in your own CI, one step at a time from the recorded history, with tool calls answered from the tape. The service compares each replayed step with the recorded one, labels and groups the steps that differ, and publishes a run report and a status check on your pull request. The check clears when members of your workspace have marked every group as expected or as a regression.

3. What the service is not

These limits are deliberate, and they are part of what you are buying. They are not defects.

Not production monitoring. The service does not watch live traffic, raise alerts or detect failures as they happen. It examines a change before release and nothing after it.

Not a judgment that your agent is correct. A replay compares a proposed change with what your agent did in production. Behavior that was already wrong in production is reported as unchanged. A clear check means every difference we found was marked by your staff, not that the agent is right.

Not a fix. The service does not write, suggest or apply changes to your prompts, code or tools.

Not a full conversation simulation. The service does not simulate users and does not run a replayed conversation past a tool call the tape did not record. Differences that would only appear later in a diverged conversation are not detected.

4. What you need to do, and why it matters

What you get from the service depends a lot on things only you control. Please read this section carefully, because sections 9 and 10 build on it.

Redaction rules. You decide what must not leave your systems and you write the redaction rules that enforce it. Recording does not start until a rule set is saved, and you are responsible for what your rules let through.

A lawful basis for recording. You tell your users what your own privacy terms require about the recording of their conversations, and you make sure you are allowed to store those conversations with us in Sweden.

A replayable agent. You maintain the configuration file that constructs your agent from a checkout without production credentials, and you provide the model provider key the replay uses. The model usage of a replay is billed to you by your provider, not by us.

Reading and marking groups. You decide which members may mark a group, and those members read the groups and mark them. A mark is your decision about your agent, recorded under the member's name.

Keeping production safe. You keep your own production monitoring and rollback in place. The service reduces what reaches production; it does not replace watching it.

5. Getting started, and what is free

The Bench plan is free without a time limit and without a payment card: one agent, one seat, 300 replayed conversations a month and 7 days of tapes. When the monthly cap is reached, replays pause until the first day of the next month and recording continues.

The Team plan is free for the first 30 days. We ask for a payment card on day 30; if none is added the workspace moves to Bench and tapes older than 7 days are deleted after a 14-day warning.

6. Fees

Plans. Bench is $0 a month. Team is $240 a month and includes 3 agents, 10 seats and 10,000 replayed conversations a month. Org is $900 a month and includes unlimited agents, 40 seats, 60,000 replayed conversations a month, SSO / SAML and the audit log. Prices are in US dollars and exclude tax.

Overage. Replayed conversations above the monthly allowance are billed in arrears at $0.01 each on Team and $0.008 each on Org. A conversation counts once per run, however many steps it has.

What is not billed. Recording tapes, importing traces, redaction, the weekly baseline run, and a repeat of a replay on the same commit and the same sample are not counted or charged.

Billing and cancellation. Plans are billed monthly in advance by card. You can cancel in Settings at any time; the plan runs to the end of the paid month and is not refunded in part. A workspace keeps the price it started on for 24 months.

7. Delivery, availability and support

Run reports. A run report is published at a stable address in the web application when a replay finishes, and the status check on the pull request links to it. The time a run takes depends on the size of the sample and on your CI and model provider, which we do not control.

The status check. The check reports blocked while any group is unmarked and clear once every group is marked. Whether a blocked check prevents a merge is set in your repository's own branch rules.

Support. Support is by email. On the Org plan we answer by the next business day in Stockholm; on other plans we answer as soon as we can, without a committed time.

8. Tapes, run reports and marks

Tapes are not edited. A tape is stored as recorded, after redaction, and is never altered by a replay. You can delete a tape; you cannot change one.

Marks are kept with a name. Every mark and note is stored with the member's name and the time. A mark can be changed, and the earlier mark stays in the run's history. On the Org plan the same events appear in the audit log.

Export. Tapes, run reports and marks can be exported as JSONL from Settings at any time, and for 30 days after a workspace is closed.

9. What we promise, and what we don’t

We promise to provide the service with reasonable skill and care, and that we have the right to provide it.

We do not promise that a replay finds every difference a change would cause in production. A replay covers a sample of past conversations, compares one step at a time from recorded history, stops at tool calls the tape did not record, and relies on labels produced by a model and on marks made by your staff.

Beyond that we give no other warranty. As far as the law allows, we exclude all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

10. Liability

10.1 Neither of us limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else the law says can’t be limited.

10.2 Losses neither of us covers. Neither of us is liable for lost profit, revenue, expected savings, business, goodwill or reputation, or for any indirect or consequential loss, however it arises.

10.3 Specific exclusions. We are not liable for the behavior of your agent in production, including behavior a replay did not surface or that your staff marked as expected; for a change you merged while a check was blocked or without a replay; for personal data that reached us because a redaction rule you wrote did not cover it; or for the cost of model usage your replays incur with your own provider.

10.4 Cap. Our total liability under these terms in any 12-month period is limited to the fees you paid us in that period, or $1,000 if you paid none.

10.5 You accept that the limits in sections 9 and 10 are a fair way to share risk, given the price and your part under section 4, and that we could not offer the service at this price without them.

11. Confidentiality and data

Each of us keeps the other's confidential information confidential and uses it only to perform these terms. Your tapes, candidate steps, run reports and marks are your confidential information. We use them only to provide the service to you, and we do not use them to train models shared with other customers unless your workspace has opted in as described in our Privacy Policy.

How we handle personal data is set out in our Privacy Policy and in the data processing agreement between us, which forms part of these terms. If the DPA and these terms disagree about personal data, the DPA wins.

12. Who owns what

You own your tapes, your prompts, your agent and everything your members write in the service. We own the service, the recorder, the command-line tool and our models.

The labeled pairs created when your members mark groups and pick labels belong to your workspace and are never shared with another customer. Today they are the record your members read when a similar group shows up again. They are used to train the classifier all customers use only if your workspace owner opts in; the opt-in is off by default, covers the two steps and the label and nothing else, and you can withdraw it for future training at any time.

You may not use our name or logo in public, and we may not use yours, without written permission first.

13. How long this lasts, and how it ends

13.1 The contract starts when you sign up and runs until one of us ends it.

13.2 You can end it. Cancel at any time. It takes effect at the end of the current billing month, unless section 6 sets a minimum term.

13.3 We can end it. We can end it with 30 days’ notice. We can end it immediately if you seriously break these terms and don’t fix it within 14 days of being told, if you become insolvent, or if your use exposes us to legal risk.

13.4 What happens then. We stop delivering and stop billing. You keep everything already delivered to you, and your right to use it continues. We delete or return our working copies as the DPA says. Sections 9, 10, 11 and 12 continue to apply.

14. Changes to these terms

We may update these terms. A change that matters takes effect 30 days after we email you about it. If you don’t accept it, you can end the contract before then. Using the service after that date means you accept the change.
